REGULAMIN

korzystania z systemu internetowego e-learning “Szkolenia BHP on-line”

I. Informacje ogólne

1. Niniejszy Regulamin określa ogólne zasady i warunki korzystania z systemu internetowego e-learning “Szkolenia BHP on-line” (zwanego dalej Portalem), warunki zawierania umów o świadczenie usług szkoleniowych, a także tryb postępowania reklamacyjnego. Dostęp do zawartych w Portalu informacji nie wymagających procesu logowania jest nieodpłatny.

2. Właścicielem Portalu jest BHP Consulting Agnieszka Brykała z siedzibą 09-411 Biała, ul. Andrzeja Kmicica 28, NIP 774-247-18-85, REGON 611423207, tel./fax. 24/ 263 45 69, www.szkoleniebhp.com.pl (zwany dalej BHP Consulting).

3. Portal działa wyłącznie poprzez sieć Internet i dostępny jest dla Użytkowników w sposób ciągły 24 godz./dobę, 7 dni w tygodniu. Stroną główną Portalu jest adres internetowy http://elearning.szkoleniebhp.pl/kursy/

4. W Portalu umieszczone są witryny z różnego typu szkoleniami on-line z zakresu BHP (zwane dalej Serwisami). Informacje dotyczące tematyki poszczególnych szkoleń zamieszczone są w opisie danego szkolenia.

5. Niniejszy Regulamin stosuje się do wszystkich Serwisów funkcjonujących w ramach Portalu chyba że dany Serwis posiada odrębny regulamin. W takim przypadku niniejszy Regulamin obowiązuje w sprawach nie unormowanych w regulaminie danego Serwisu.

6. BHP Consulting zastrzega sobie możliwość wprowadzania nowych Serwisów oraz modyfikowania lub usunięcia dotychczasowych Serwisów w dowolnym momencie (za wyjątkiem sytuacji, gdy z usuwanego Serwisu korzysta Użytkownik – wtedy jego usuniecie nastąpi dopiero po zakończeniu korzystania z niego przez ostatniego Użytkownika).

7. Niniejszy Regulamin jest udostępniony Użytkownikom nieodpłatnie na stronie Portalu, a na ich żądanie może być udostępniony także w taki sposób, który umożliwia im pozyskanie, odtwarzanie i utrwalanie treści Regulaminu za pomocą systemu teleinformatycznego, którymi posługują się Użytkownicy.

8. Przed dokonaniem aktywacji konta celem skorzystania z Serwisów Portalu, Użytkownik zobowiązany jest zapoznać się z Regulaminem. Użytkownik, aktywując konto w Portalu potwierdza, że zapoznał się z regulaminem i że akceptuje wszystkie jego postanowienia.

9. Niniejszy Regulamin obowiązuje od momentu jego opublikowania na stronie Portalu. BHP Consulting zastrzega sobie prawo do wprowadzania zmian w Regulaminie, które stają się obowiązujące z chwilą ich umieszczenia na stronie Portalu. Zarejestrowani Użytkownicy zostaną powiadomieni przez BHP Consulting o zakresie zmian w treści niniejszego Regulaminu, otrzymując wiadomość elektroniczną na podany w formularzu aktywacyjnym adres e-mail. Brak reakcji ze strony Użytkownika w zakresie wprowadzonych zmian w Regulaminie w terminie 7 dni roboczych od daty otrzymania informacji poczytany będzie przez BHP Consulting za ich akceptację. Odmowa przyjęcia zmian Regulaminu oznacza rezygnację Uczestnika z korzystania z Portalu.

10. Szkolenia BHP realizowane w ramach Portalu są zgodne z rozporządzeniem Ministra Gospodarki i Pracy z dnia 27 lipca 2004r. w sprawie szkolenia w dziedzinie bezpieczeństwa i higieny pracy (Dz. U. Nr 180, poz. 1860 z późn. zm.), świadczenie tych usług w formie on-line zgodne jest z ustawą z dnia 18 lipca 2002r. o świadczeniu usług drogą elektroniczną (Dz. U. Nr 144, poz. 1204), zaś zbieranie, przetwarzanie i udostępniane danych osobowych Użytkowników z Ustawą o Ochronie Danych Osobowych z dnia 29 sierpnia 1997 r. (Dz. U. Dz.U. 1997 nr 133 poz. 883) oraz Rozporządzeniem Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (RODO).

II. Warunki korzystania z Portalu

1. Warunkiem prawidłowego działania z Portalu na komputerze Użytkownika i możliwości uczestniczenia w wybranym szkoleniu jest posiadanie dostępu do sieci Internet, przeglądarki internetowej z możliwością zapisu plików cookies oraz programów dodatkowych potrzebnych do odczytania bądź odtwarzania elementów zawartych w Portalu. Użytkownik musi posiadać również aktywne konto e-mail. W przypadku jakichkolwiek problemów z dostępem do Portalu, lub z udziałem w szkoleniu, Użytkownik może zwrócić się o pomoc do BHP Consulting pod numerem telefonu 24 263-45-69 lub adresem e-mail: e-learning@pogotowiebhp.com.pl

2. Użytkownik uzyskuje dostęp do Serwisów Portalu poprzez zarejestrowanie konta w Portalu i zakup wybranego szkolenia on-line lub po udostępnieniu przez BHP Consulting loginu i hasła.

3. Użytkownik, w celu utworzenia konta, wypełnia formularz aktywacyjny, zawierający podstawowe pytania o imię i nazwisko, datę i miejsce urodzenia. Podanie danych osobowych nie jest obowiązkowe. Jest jednak konieczne do korzystania z Serwisu i otrzymania zaświadczenia o ukończeniu szkolenia. Użytkownik zobowiązany jest podać dane prawdziwe.

4. BHP Consulting dopuszcza możliwość korzystania z Serwisów przez Użytkowników po zgłoszeniu takiego zapotrzebowania przez ich pracodawców lub inne osoby i podaniu adresu e-mail każdego z Użytkowników, na który zostanie przesłany formularz aktywacyjny, o którym mowa w pkt. 3.

5. Użytkownikowi nie wolno udostępniać swojego konta innym osobom.

6. Niedopuszczalne są wszelkie próby ingerencji w konta innych Użytkowników.

7. Każdy Użytkownik, który dokonał aktywacji w Portalu, jest zobowiązany przestrzegać zasad w nim obowiązujących, określonych w niniejszym Regulaminie.

8. Zakazane jest i rozumiane jako naruszenie Regulaminu:

- używanie kont w celach innych niż uczestnictwo w szkoleniach on-line,

- umieszczanie materiałów o charakterze bezprawnym, w tym o charakterze pornograficznym i wulgarnym, o treściach naruszających prawa osób trzecich, a także wzywających do nienawiści rasowej, etnicznej, wyznaniowej itp. oraz propagujących przemoc,

- używania Portalu do dystrybucji nielegalnego oprogramowania, plików z muzyką, co do których Użytkownik nie posiada praw autorskich,

- zamieszczania elementów, które służyłyby do promocji innych stron, witryn lub portali internetowych.

III. Szkolenia BHP on-line

1. W celu skorzystania z Serwisu Użytkownik winien dokonać:

- Wyboru interesującego go Serwisu,

- Płatności na rachunek BHP Consulting Agnieszka Brykała ul. Andrzeja Kmicica 28; 09-411 Biała 50 1020 5558 1111 1417 6410 0059. Płatności nie dokonują Użytkownicy, którzy korzystają z Serwisów w ramach zawartych wcześniej umów z BHP Consulting, bądź którym przyznane zostało przez BHP Consulting prawo nieodpłatnego korzystania.

- Przyjęcia przesłanego do Serwisu loginu i hasła.

- Wypełnienia formularza aktywacyjnego

2. Użytkownik ma dostęp do Serwisu przez okres 30 dni od daty pierwszej rejestracji. W tym terminie zobowiązany jest ukończyć szkolenie i zdać egzamin końcowy. Czas trwania szkolenia nie powinien być krótszy od liczby godzin wskazanych w rozporządzeniu Ministra Gospodarki I Pracy z dnia 27 lipca 2004 r. w sprawie szkolenia w dziedzinie bezpieczeństwa i higieny pracy (Dz. U. Nr 180, poz. 1860)., tj.

· Pracodawcy i inne osoby kierujące pracownikami – min. 16 godzin lekcyjnych (45 min./1 godzina lekcyjna)

· Pracownicy inżynieryjno – techniczni – min. 16 godzin lekcyjnych (45 min./1 godzina lekcyjna)

· Pracownicy służby bezpieczeństwa i higieny pracy i osoby wykonujące zadania tej służby - min. 32 godziny lekcyjne (45 min./1 godzina lekcyjna)

· Pracownicy administracyjno – biurowi i inni, o których mowa w § 14 ust. 2 pkt 5 rozporządzenia – min. 8 godzin lekcyjnych (45 min./1 godzina lekcyjna)

Po upływie terminów wskazanych powyżej uczestnik szkolenia może dopiero przystąpić do testu egzaminacyjnego.

Po upływie przewidzianego na ukończenie szkolenia BHP Consulting blokuje dostęp do Serwisu. W przypadku ukończenia szkolenia przed upływem powyższego terminu, dostęp do Serwisu blokowany jest użytkownikowi po upływie 24 godzin od zdania egzaminu.

3. Szkolenia on-line składają się z modułów tematycznych, które Uczestnik przechodzi po kolei. Każdy moduł zawiera quizy, które należy rozwiązać. Rozpoczynając szkolenie uczestnik ma dostęp do I modułu. Warunkiem dostępu do kolejnych modułów jest uzyskanie min. 60% poprawnych odpowiedzi z quizów zawartych w aktywnych modułach (możliwość monitorowania wyników w zakładce OCENY).

4. Szkolenie kończy się egzaminem końcowym w postaci testu składającego się z pytań jednokrotnego wyboru.

5. Warunkiem uzyskania zaświadczenia o pozytywnym ukończeniu szkolenia jest udzielenie min. 60% poprawnych odpowiedzi zawartych w teście egzaminacyjnym.

6. Niezaliczenie szkolenia skutkuje nieotrzymaniem zaświadczenia (certyfikatu) o odbyciu szkolenia.

7. Użytkownikowi z powodu niezaliczenia szkolenia nie przysługują roszczenia finansowe ani zwrot opłaty wniesionej za szkolenie płatne.

8. Zaświadczenie o odbyciu szkolenia w wersji pliku PDF użytkownik może pobrać w zakładce „CERTYFIKAT UKOŃCZENIA SZKOLENIA”. Dokument w tej formie nie stanowi jednak potwierdzenia ukończenia szkolenia w myśl rozporządzenia Ministra Gospodarki i Pracy z dnia 27 lipca 2004r. w sprawie szkolenia w dziedzinie bezpieczeństwa i higieny pracy (Dz. U. Nr 180, poz. 1860). Takim dokumentem jest zaświadczenie w wersji papierowej, opatrzone oryginalnymi pieczęciami i podpisami, które BHP Consulting będzie wysyłał Użytkownikom przesyłką listowną na adres przez nich wskazany w formularzu aktywacyjnym, chyba że strony ustalą inny sposób jego doręczenia.

IV. Materiały szkoleniowe i prawa autorskie

1. Użytkownik ma obowiązek korzystać z materiałów zamieszczonych na Portalu w sposób zgodny z prawem i postanowieniami Regulaminu. Uczestnik nie może udostępniać w jakiejkolwiek formie żadnych materiałów stanowiących treść szkolenia osobom trzecim.

2. Zasoby i cała pozostała zawartość Portalu, taka jak teksty, grafiki, animacje, zdjęcia, dźwięki, logotypy, przyciski, obrazki, zawartość baz danych i aplikacje dostępne w Portalu stanowią własność intelektualną BHP Consulting lub podmiotów, z którymi zawarł on stosowne umowy i są chronione przez polskie i międzynarodowe przepisy dotyczące ochrony własności intelektualnej, w szczególności przez przepisy ustawy z dnia 04 lutego 1994r. o prawie autorskim i prawach pokrewnych (Dz. U. z 2006r., Nr 90, poz. 631).

3. Zabronione jest bez zgody BHP Consulting kopiowanie, powielanie lub jakiekolwiek inne wykorzystywanie w całości lub we fragmentach informacji, danych lub innych treści dostępnych na łamach Portalu lub z niego pochodzących, za wyjątkiem przypadków dozwolonego użytku wynikających z powszechnie obowiązujących przepisów prawa.

4. Zabronione jest pobieranie zawartości baz danych udostępnionych w Portalu i wtórne ich wykorzystanie w całości lub w części.

5. Każde naruszenie praw autorskich BHP Consulting może skutkować podjęciem działań prawnych w kierunku pociągnięcia sprawcy naruszeń do odpowiedzialności cywilnej i/lub karnej, zgodnie z przepisami prawa.

V. Przetwarzanie i ochrona danych osobowych

1. Rejestrując się w Portalu, Użytkownik wyraża zgodę na przetwarzanie jego danych osobowych przez BHP Consulting dla celów związanych ze świadczeniem zamówionych usług. Użytkownik podaje swoje dane osobowe na zasadzie dobrowolności.

2. Dane o użytkowniku uzyskane w trakcie korzystania przez niego z usług świadczonych drogą elektroniczną w ramach Portalu będą wykorzystywane wyłącznie w celach związanych z udziałem Użytkownika w szkoleniach i nie będą ujawniane osobom trzecim, z wyjątkiem przypadków, gdy ujawnienie powyższych informacji wymagane jest przepisami prawa.

3. Użytkownikowi przysługuje prawo wglądu do własnych danych osobowych, ich poprawiania oraz do żądania zaprzestania ich przetwarzania.

4. Żądanie zaprzestania przetwarzania danych osobowych jest równoznaczne z rezygnacją z udziału w szkoleniu.

5. Funkcję Administratora danych osobowych pełni BHP Consulting.

6. BHP Consulting zobowiązuje się do przestrzegania tajemnicy związanej z danymi osobowymi.

VI. Reklamacje

1. BHP Consulting zobowiązuje się dołożyć wszelkich starań, by usługi świadczone w ramach Portalu były na najwyższym poziomie. Zobowiązuje się zapewnić stałe, ciągłe i bezawaryjne działanie Portalu.

2. Reklamacje dotyczące niepoprawnego działania jakiejkolwiek części Portalu, związanej ze świadczonymi na rzecz Użytkownika usługami należy zgłaszać poprzez formularz kontaktowy znajdujący się w zakładce Kontakt Portalu lub wysłać wiadomość bezpośrednio na adres e-mail: e-learning@pogotowiebhp.com.pl

3. Zgłaszana reklamacja powinna zawierać między innymi opis „Reklamacja” w tytule wiadomości, oraz imię i nazwisko Użytkownika zgłaszającego oraz adres e-mail i treść opisującą rodzaj zdarzenia będącego podstawą zgłaszanej reklamacji.

4. W terminie 10 dni roboczych od daty otrzymania prawidłowo przesłanej reklamacji, na podany w zgłoszeniu reklamacyjnym adres e-mail zostanie wysłana odpowiedź odnosząca się do treści otrzymanej reklamacji.

VII. Postanowienia końcowe

1. BHP Consulting zastrzega sobie prawo czasowego zawieszania pracy Portalu w przypadku konieczności przeprowadzania jego modernizacji, naprawy, konserwacji systemów obsługujących Portal lub w celu jego rozbudowy.

2. W przypadku, gdy przerwa lub czasowe zawieszenie pracy Portalu będą możliwe do przewidzenia, BHP Consulting powiadomi Użytkowników biorących udział w szkoleniach o takim zdarzeniu z odpowiednim wyprzedzeniem, wysyłając im informację na adres e-mail.

3. Z przyczyn technicznych BHP Consulting ma prawo do wprowadzania zmian w kontach Użytkowników.

4. BHP Consulting zastrzega sobie prawo czasowego zablokowania Użytkownikowi dostępu do Portalu z następujących przyczyn:

- nie przestrzegania warunków Regulaminu przez Użytkownika,

- nie dokonania płatności za szkolenie,

- podejrzenia o korzystanie z Portalu przez inne osoby podające parametry dostępu przyznane Użytkownikowi,

- podejrzenia o wykorzystaniu informacji zawartych w Portalu w celach nieuczciwej konkurencji, a w szczególności kopiowania lub rekompilowania struktury oprogramowania Portalu.

5. Odblokowanie dostępu może nastąpić wyłącznie po wyjaśnieniu przyczyny zablokowania.

6. Jeżeli przyczyna zablokowania nie będzie wyjaśniona na drodze wzajemnych ustaleń w ciągu 7 dni usunie konto Użytkownika z Portalu.

7. W sprawach nieuregulowanych przez niniejszy Regulamin zastosowanie znajdują przepisy prawa polskiego.

8. Spory mogące wyniknąć, w związku z korzystaniem ze świadczonych usług przez Użytkowników z Portalu oraz z treści niniejszego Regulaminu, których nie da się rozstrzygnąć polubownie, poddane zostaną rozstrzygnięciu przez sąd właściwy miejscowo i rzeczowo dla siedziby pozwanego.

Internet e-learning system

I. General Information

1. The Terms of Use define the regulations that govern the use of the online e-learning system "health and safety training on-line" (hereinafter referred to as the Portal), conditions for entering into the contract that provides the training services, as well as detail the complaints procedure. Access to the information contained in the Portal not requiring registration is free.

2. The Portal is owned by BHP Consulting Agnieszka Brykała with the headquarter 09-411 Biała, ul. Andrzeja Kmicica 28, NIP 774-247-18-85, REGON 611423207, tel./fax. 24/ 263 45 69, www.szkoleniebhp.com.pl (hereinafter referred to as BHP Consulting).

3. The Portal operates exclusively via the Internet and is available to users 24 hours a day 7 days a week. The URL for the Portal's home page is http://elearning.szkoleniebhp.pl/kursy/

4. The Portal includes a variety of on-line Health & Safety training services (hereinafter referred to as the Services). The description of each training module provides the information regarding the topic that you will be trained in.

5. These Terms of Use shall apply to all Services functioning within the Portal, unless a given Service has its own terms of use. In this case, these Terms of Use apply in cases not regulated by specific terms of use of the Service.

6. BHP Consulting reserves the right to introduce new Services and modify or delete existing Services at any time (except when a given Service is being used by a User – in this event, the Service will be removed after the last User finishes using the Service).

7. These Terms of Use are available to the users free of charge on the Portal's website. If requested by a User, it can be also made available in a different form allowing the user to download, read and save the Terms of Use using information and communication technology (ICT) used by a User.

8. Before activating an account in order to be able to use the Portal Services, the User is obliged to read the Terms of Use. By activating the account on the Portal, the User confirms that they have read and accepted the provisions of the Terms of Use.

9. These Terms of Use shall apply from the moment of its publication on the Portal. BHP Consulting reserves the right to make changes to the Terms of Use, which shall become effective upon their placement on the Portal. Registered Users will be notified by BHP Consulting via email that was provided by the User during the activation process about the scope of changes in the contents of the Terms of Use. If no response is received from the User regarding the changes within 7 working days, it is deemed that the changes have been accepted. The refusal to accept the changes to the Terms of Use are will be deemed as resignation from the use of the Portal.

10. Health and safety trainings conducted within the Portal comply with the Regulation of the Minister of Economy and Labour of 27 July 2004 on trainings in area of occupational health and safety (Journal of Laws No. 180, item. 1860, as amended). Providing online health and safety training services is consistent with the Act of 18 July 2002 on providing electronic services (Journal of Laws No. 144, item. 1204). Collecting, processing and providing access to the personal data is consistent the Personal Data Protection Act of 29 August 1997 (Journal of Laws 1997, No. 133, item 883) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (GDPR).

II. Terms of Use of the Portal

1. For the Portal to function properly on the User's computer and for the User to be able to participate in selected trainings there must be access to the Internet, a cookie enabled web browser, and other programs required to read or play certain elements of the Portal. The User must also have an active e-mail account. 2. The User receives access to the Portal Services after registering on the Portal and purchasing an on-line training, or after receiving a login and password from BHP Consulting.

3. In order to register, the User must fill in an activation form including the following information: first name and last name, date and place of birth. Providing personal information is not compulsory, however it is required to use the Services and receive a certificate confirming the completion of the training. The user is obliged to provide accurate information.

4. BHP Consulting allows access to the Services to Users, whose application and e-mail address for each User were submitted by their employer or another individual. The activation form referred to in point 3 will be sent to the email address provided by the employer.

5. The User cannot give access to their account to another person.

6. Any attempts to tamper with the accounts of other users are unacceptable.

7. Every User who activates their account with the Portal, is obliged to comply with Terms of Use of the Portal.

8. The following activities are prohibited and understood as a violation of the Terms of Use:

– using the account for purposes other than participation in on-line trainings,

– uploading illegal materials, including pornographic and vulgar content violating the rights of third parties, as well as inciting racial, ethnic, religious hatred, and promoting violence,

– using the Portal for the distribution of illegal software or music files for which the user does not have the copyright,

– uploading elements in order to promote other websites, services or portals.

III. On-line Health and Safety Trainings

1. In order to use the Portal Services the user should:

- Select a Service,

- Make payment to the following bank account: BHP Consulting Agnieszka Brykała ul. Andrzeja Kmicica 28; 09-411 Biała 50 1020 5558 1111 1417 6410 0059. Users who have existing contracts with BHP Consulting, or who have been granted free access to the services by BHP Consulting, are not required to make the payment,

- Accept generated login and password to the Service,

- Complete the activation form.

2. The user retains the access to the Service for a period of 30 days from the date of first registration. During this time they are required to complete the training and pass the final test. Duration of the training should not be shorter than the time specified in the Regulation of the Minister of Economy and Labour of 27 July 2004 on training in the area of occupational health and safety (Journal of Laws No. 180, item . 1860). The following limits apply:

· Employers and other persons directing employees – minimum 16 lessons (1 lesson = 45 min)

· Technicians and engineers - minimum 16 lessons (1 lesson = 45 min)

· Members of HSE services at the workplace and employees who perform HSE tasks - minimum 32 lessons (1 lesson = 45 min)

· Administrative and clerical staff and other positions referred to in § 14 item 2 point 5 of the above mentioned Regulation - minimum 8 lessons (1 lesson = 45 min)

The user is able to take the test only after the period of time specified above

After the expected time for competition of the training passed, BHP consulting blocks the access to the Service. In an event of completing the course before the deadline, access to the Service is blocked 24 hours after taking the test.

2. On-line training consist of thematic modules, that a participant needs to take in a particular order. Each module includes a quiz to be solved. A participant has access to module I when starting the training. In order to gain access to the next module the participant must obtain a minimum of 60% of correct answers in quizzes contained in the active modules (the user can monitor their performance in ASSESSMENT tab).

3. The training ends with a final test, which is a multiple choice test.

4. It is required to obtain a minimum of 60% of correct answers in the final test in order to obtain a certificate of successful completion of the training.

5. Failure to pass the final test will result in the user not receiving the certificate of successful completion of the training

6. Failure to complete the training does not entitle the user to any financial claims or a refund of the training fee.

7. In accordance with the Regulation of the Minister of Economy and Labour of 27 July 2004 on training in area of occupational health and safety (Journal of Laws No. 180, item. 1860) a confirmation of the completion of the training shall be a paper certificate bearing the original stamps and signatures, which will be posted by BHP Consulting to the address provided by the User in the activation form, unless the parties agree a different method of delivery.

IV. Training Materials and Copyright

1. The User is obliged to use the materials on the Portal in a manner consistent with the law and the provisions of the Terms of Use. The participant must not make available the contents of the training materials in any form to third parties

2. The resources and the entire remaining contents of the Portal, such as text, graphics, animations, images, sounds, logos, buttons, images, content of databases and applications available on the Portal are the intellectual property of BHP Consulting or entities with whom it has entered into appropriate agreements and are protected by Polish and international regulations concerning the protection of intellectual property, in particular the provisions of the Act of 4 February 1994 on copyright and related rights (Journal of Laws of 2006., No. 90, item. 631).

3. It is prohibited to copy, reproduce or use in any other way, in whole or in part, information, data or other content available within the Portal or derived from the Portal without the permission of BHP Consulting, except for cases of permissible use under the generally applicable laws.

4. It is prohibited to download the contents of the databases available on the Portal and re-utilize them in whole or in part.

5. Any infringement of BHP Consulting copyright may result in legal actions to bring the perpetrator of the violations to civil and/or criminal liability pursuant to the relevant law.

V. Processing and Protection of Personal Data

1. By registering on the Portal, the User consents to the processing of their personal data by BHP Consulting for the purposes of providing the requested services. The user provides personal data on a voluntary basis.

2. User data obtained in the course of their use of the electronic services within the Portal will be used only for the purposes related to the participation of the User in training and will not be disclosed to third parties, except cases where the disclosure of the above information is required by law.

3. The User has the right to access their personal data, rectify it and to request the processing of their data to end.

4. The request to stop processing the user’s personal data is tantamount to resignation from participating in the training.

5. BHP Consulting is the Personal Data Administrator

6. BHP Consulting is obliged to respect the confidentiality of personal data.

VI. Complaints

1. BHP Consulting is obliged to make every effort to ensure that the Services provided within the Portal are of the highest quality. BHP Consulting is obliged to provide permanent, continuous and trouble-free operation of the Portal.

2. Complaints regarding problems with any part of the Portal related to the services provided to the User must be reported via the contact form located in the Contact tab of the Portal or a an email sent to:

3. The complaint should contain, among others, "complaint" in the title of the message, the body of the message should include User’s name and email address and the description of the incident that caused the User to complain.

4. The reply to the complaint will be sent to the email address provided in the complaint within 10 working days of the receipt of the correctly completed and sent complaint.

VII. Final Provisions

1. BHP Consulting reserves the right to temporarily suspend the operation of the Portal in order to carry out modernization and repair works, maintenance of the systems supporting the Portal, or for system development purposes.

2. If the interruption or temporary suspension of the operation of the Portal is planned or possible to predict, BHP Consulting will notify the Users participating in the trainings about such event in advance by sending an information by e-mail.

3. For technical reasons, BHP Consulting has the right to make changes to the User accounts.

4. BHP Consulting reserves the right to temporarily block User’s access to the Portal for the following reasons:

· Non-compliance with the provisions of the Terms of Use by the User

· Non-payment of the training fee

· If we believe the use of the Portal is by a different person from the details provided who provides the same login details as the User,

· If we believe that the information contained in the Portal is used for the purposes of unfair competition, in particular, copy or recompile the Portal’s software structure.

5. The access can be unlocked only after clarifying the situation and reason for blocking the account..

6. If the reason for blocking the account is not clarified by mutual agreement within 7 days the account will removed from the Portal .

7. In matters not covered by the Terms of Use Polish law is applicable.

8. Any disputes that may arise in connection with the use of provided services by Users of the Portal and the Terms of Use , which cannot be settled amicably , will be subject to resolution by a competent court in the relevant jurisdiction as stipulated above.
